PURCHASE AGREEMENT
1. Minimum pet deposits are $250.00, and the minimum breeder or show/breeder deposits are $400.00. You may leave a higher deposit amount if you choose, for either a pet, breeder or show/breeder kitten. Deposits are non refundable, and they do apply, even if the kitten is paid in full at time of purchase (there are no exceptions). Deposits are only transferrable to another available kitten that is currently born, or one from a future litter, but not necessarily the same color or pattern.
2. No kitten/cat will be held, whether implied or stated without a deposit and an ORIGINAL SIGNED CONTRACT within 7 days. For Buyers convenience, Seller accepts instant credit card & Echeck payments online with a small fee via Paypal. If Buyer chooses, he/she can mail a check, money order or cashiers check as deposit. Note, if sending a check as final payment, it must clear your bank at least 2 weeks before kitten or cat is allowed to be released, which is at 12 weeks of age. Final payment is due NO LATER than two weeks prior to the kitten release date.
1. Buyer is aware they are purchasing a live animal, and accepts responsibility of any and all medical treatment and care associated with this animal after release date.
2. Seller will provide Buyer at time of pickup or delivery with a health record, which indicates when vaccines, dewormings, and the veterinarian examination was completed. The Seller will also provide registration papers, and a free kitten starter kit.
3. Seller represents and warrants that said Ragdoll is in good health. Buyer is encouraged to have said Ragdoll examined at his/her option and sole expense by a licensed veterinarian within 72 hours of pick-up or delivery. This should be done if said Ragdoll’s health is in question, or if Buyer just wants peace of mind that said Ragdoll is in good health. If within the 72 hour period, such veterinarian's examination reveals any defect in health of said Ragdoll, Buyer must provide Seller within 24 hours of such examination that the examination revealed a defect in health of said Ragdoll. If legitimate proof is provided to Seller, then Buyer has the option to return said Ragdoll in same condition to Seller within 72 hours, and a full refund will be given of the purchase price. Upon no condition shall Seller be responsible for payment of any medical exams or treatments of said Ragdoll by the Buyer.
4. Seller guarantees, said Ragdoll to be free of mites, fungus, and that they are also negative for FIV and FELV at the time of pickup or delivery.
5. Seller agrees to replace said Ragdoll with another pet quality Ragdoll, though not necessarily the same age, color, pattern or sex as the original Ragdoll, if from two years of said Ragdoll’s date of birth, said Ragdoll is found to have any hereditary or congenital defects, including FIP, which caused the death of said Ragdoll (providing the Seller is still breeding). Buyer agrees to show confirmation beyond any reasonable doubt, by a written necropsy report (at Buyer's sole expense), performed and signed by an unpartial licensed Board Certified Veterinary Pathologist.
6. All kittens have received their first two vaccinations, and are dewormed.
7. Seller will not be held responsible for any type of common feline infections known to affect cats beyond the 72 hour health guarantee. Buyer agrees there are common infections cats are often subject to suffer, and are beyond the control of the Seller.
1. Said kitten/cat will not be allowed to roam outdoors, without a safe enclosure with protection from the elements. Such enclosure will not be primary housing for said kitten/Cat.
2. Said kitten/cat cannot be sold or given to a pet store, research lab, animal shelter, or similar facility.
3. Said kitten cannot be declawed; otherwise ALL health guarantees are null and void.
4. Buyer understands all pet kittens will be spayed/neutered before going to their new home.
5. Buyer agrees that Said kitten/cat will not be given the inoculation for Feline Infectious Peritonitis(FIP) or Feline Lukemia (FELV); otherwise any and all health guarantees in this agreement become null and void. Buyer acknowledges these are controversial vaccines, and that they do not provide 100% immunity.and also that cats have at times had adverse reactions as well as die when given them.
6. Seller will provide registration papers for pet buyers (and a 3 generation pedigree for breeders only), upon receipt from TICA or CFA.
7. There are no guarantees on future health or show achievements of said kitten.
8. Buyer is responsible for any and all shipping charges incurred.
9. If said kitten is bieng purchased as a breeder, and at any time in the future, Buyer decides they will no longer be utilizing said Ragdoll in their breeding program, Buyer must contact the Seller prior to altering said Ragdoll. Seller has the first right to purchase back said Ragdoll, which is to be at a cost not to exceed 1/2 of the original purchase price. If Seller declines purchasing back said Ragdoll in writing, then the Buyer must alter said Ragdoll and provide written proof to Seller within 10 days prior to being kept by Buyer, or before being placed in a pet home.
10. If said kitten is purchased as a breeder or show/breeder, Buyer agrees not to re-sell, trade or give away said cat to another breeder/cattery or other person whom has intent to breed. If Said cat is a male, he may not be sold for stud service to anyone. If Said cat is a female, she may not be bred with any male cat other than those owned by the Buyer. Buyer agrees not to sell, trade, or give away any female or male breeder or show/breeder kittens as breeders to anyone from said cat, unless written permission is granted by Seller. Also, Buyer agrees all pet kittens sold from said cat, must be altered prior to placement.
11. If said cat is sold as a breeder, Seller guaranteees fertility. If said cat does not produce a litter of kittens (1 or more), by the time the cat is 2 years of age (when bred to at least 2 proven breeding cats, and no offspring were produced and/or registered), then the Buyer has the option to alter the cat (providing legitimate proof to the Seller by a licensed veterinarian that the cat is infertile), and Seller will replace the cat with a kitten of equal quality as soon as possible.
12. Seller reserves the right to cancel the sale of any kitten or cat to said Buyer at anytime and not refund the initial deposit, for any of the following reasons: The Seller realizes the Buyer is unable or refuses to properly house, feed, spend adequate time weekly with the kitten/cat, if it is found that the Buyer has too many animals currently living in their home, if the kitten should be considered by the Seller to be of show or breeder quality (if so, then the Buyer will have the option of another kitten), and finally, if the Buyer is disrespectful toward the Seller in any way.
13. Any legal fees incurred, by failing to comply with the above conditions, will be the responsibility of the Buyer, and will be filed and governed by, construed, and enforced in accordance with the laws of the state of Texas and in the county where the Seller resides. Buyer acknowledges they have read the entire page regarding the sale of kittens/cats on the website and contract, and are fully aware of the terms therein.
14. Buyer’s signature, indicates full agreement and approval of all conditions.
